Article 10: Reverse effect of criminal law
1. A criminal law that eliminates the crime of an act, mitigates the punishment or otherwise improves the position of the perpetrator shall have retroactive effect, i.e. shall apply to persons who have committed an offence. Persons who have committed acts prior to the entry into force of the Act, including persons serving a sentence or who have served a sentence but who have been convicted. 2. If the new criminal law mitigates the penalty for an act that is served by a person, the penalty shall not be retroactive. It is subject to reduction within the limits provided for in the new criminal law.
