Article 47: Loss of the right to hold certain positions or engage in certain activities

1. The deprivation of the right to hold certain positions or engage in certain activities consists of the prohibition of holding public office, local government office or non-governmental organization posts. 2. The deprivation of the right to hold certain positions or engage in certain activities shall be for a period of one to five years. In cases specifically provided for in the relevant articles, special penalties may be imposed on persons who have been sentenced to six months to three years as the main form of punishment and for a period of six months to three years as an additional penalty. 3. The deprivation of the right to hold certain positions or engage in certain activities shall be imposed for up to twenty years as an additional penalty. the right to hold certain positions or engage in certain activities may be imposed as an additional penalty and in cases where it is not provided for Article of the Special Part of this Code as punishment for the offence in question if, in view of the nature and degree of danger to society of the crime committed and the identity of the perpetrator, 4. In the event that this type of punishment is imposed as a complement to the obligation to retain the right to hold certain positions or engage in certain activities, it shall be recognized that it is not possible to retain the right to hold certain positions or to engage in certain activities. In the event of deprivation of liberty, the sentence may be imposed only if the sentence has entered into force. to hold certain positions or engage in certain activities as an additional form of punishment for arrest, detention in a disciplinary military unit, forced labour, The right to liberty shall be applicable at all times to the execution of these basic penalties, but shall be calculated from the time they are served.
