Article 60: General commencement of sentencing

1. A person found guilty of an offence shall be given a fair punishment within the limits prescribed in the relevant article of this Code and subject to the provisions of the Code of Criminal Procedure. A more severe penalty for a crime is imposed only if the less severe penalty cannot achieve the same degree of satisfaction. 2. A more severe penalty than is provided for in the relevant articles of the Special Part of this Code may be imposed on the whole of the crime committed. In accordance with articles 69 and 70 of the present Code, the grounds for the imposition of a lesser penalty than those laid down in the relevant article of the Special Part of the 3. The nature and degree of social danger of the crime and the identity of the perpetrator shall be taken into account in the imposition of the penalty. These include circumstances that mitigate and increase the penalty, as well as the impact of the sentence imposed on the reform of the convicted person and on the living conditions of his or her family.
