Article 3.8: Elimination of a special right
1. The deprivation of a person who has committed an administrative offence, which has previously been granted a special right, shall be deemed to be a gross or systematic violation of the rules governing the exercise of this right. The deprivation of a person ' s prior special right is also established for non-compliance, and the deprivation of a person ' s right under the provisions of the articles of the Special Part of the present Code. In cases covered by articles of the Special Part of this Code, for violation of the rights set forth in the Covenant, the Committee is concerned at the fact that the State party has failed to comply with its obligations under the Covenant. 2. The period of deprivation of a special right shall be fixed by the judge. 3. The deprivation of a special right in the form of driving rights may not apply to a person using a vehicle. with regard to disability, except in cases of administrative offences under article 12.8, parts 1 and 2, article 12.9, part 7, article 12.10, part 3, article 12.15, part 5 4. The deprivation of a special right in the form of the right to hunt may not be applied to persons who, in accordance with article 12.26, paragraph 1, of article 12.27, paragraph 3, of the present Code. hunting is the main legitimate source of livelihood, except in the cases provided for in article 8.37, paragraph 1.2, of the present Code.
