Article 108: Murder committed if the limits of the necessary defence are exceeded or if the measures necessary to apprehend the perpetrator of the offence are exceeded
1. Murder committed if the limits of the necessary defence are exceeded is punishable by punitive deduction of earnings for up to two years, or restriction of liberty for up to two years, or by forced labour. 2. Murder committed when the measures necessary to apprehend the perpetrator are exceeded shall be punishable by restriction. In addition, the Committee notes that the State party has not provided any information on the number of cases in which the complainant has been subjected to torture or ill-treatment, and that the State party has not provided any evidence of torture or ill-treatment.
