Article 41: A reasonable risk
1. It is not an offence to harm a protected interest under criminal law, with a reasonable risk to achieve a socially useful objective. 2. Risk shall be considered reasonable if the risk is reasonable. The non-risk (inaction) actions could not be achieved, and the risk-taker has taken sufficient measures to prevent harm to the protected interests of the criminal law. 3 The risk is not justified if it is known to pose a threat to the lives of many people, an environmental disaster or a social disaster.
