Article 30: Limitation of a citizen ' s legal capacity

1. A citizen who, because of gambling, alcohol or substance abuse, puts his family in a difficult financial position may be limited The court has the power to act in accordance with the procedure established by the civil procedure law and is responsible for the custody of the court and is free to make small transactions in the home on its own. The transaction performed by such a citizen is also valid upon its subsequent written approval by the trustee. Under article 26, paragraph 2, of the Code, such a citizen is entitled to perform independently. by means of alimony, social pension, health compensation and the death of the breadwinner and other payments made for his maintenance, with written consent Except for the payment referred to in article 26, paragraph 2, subparagraph 1, of the present Code, to which he or she is entitled to dispose of the payment in question. The order of the said payments may be terminated before the expiry of the period by decision of the trustee. The guardianship or guardianship authority may restrict or deprive such a citizen of the right to dispose of his or her own income as set out in article 26, paragraph 2, subparagraph 1, of the Covenant. A citizen whose legal capacity has been restricted by a mental disorder shall be liable on his own property for transactions performed by him or her in accordance with the requirements of the Code of Criminal Procedure. 3. If the grounds on which the citizen was restricted in his or her capacity were dismissed, the court shall decide whether the person concerned is liable for the injury caused to him or her in accordance with this Code.
