Article 309.1. Creditors ' agreement on how to satisfy their claims against the debtor

1. An agreement may be concluded between creditors of a single debtor on a homogeneous basis on how to satisfy their claims against the debtor, including the priority of satisfaction and not on the extent to which the debtor would be entitled to the benefit of the debtor. Parties to the said agreement are obliged not to perform acts intended to obtain performance from the debtor in violation of the terms of the said agreement. 2. Execution received from the debtor by one creditor in violation of the terms of the agreement between creditors to satisfy their claims against the debtor is to be transferred to the creditor under another obligation A creditor that has transferred performance from the debtor to another creditor shall be subject to the latter ' s claim to the debtor in accordance with the terms of the agreement. 3. The agreement of creditors on how to satisfy their claims against the debtor does not create obligations for persons not participating as parties, including the debtor (art. 308).
