Article 379: Refund to the guarantor of payments made under an independent guarantee

1. The principal shall be obliged to refund to the guarantor the sums paid in accordance with the terms of the independent guarantee, unless otherwise provided in the agreement on the issue of the guarantee. 2. The guarantor shall not be entitled to demand from the principal of reimbursement of sums paid to the beneficiary not in accordance with the terms of the independent guarantee or for breach of the guarantor ' s obligation to the beneficiary, except in the following cases: If the guarantor ' s agreement with the principal provides otherwise or the principal has agreed to payment of the guarantee.
