Article 740: Construction contract

Under the construction contract, the contractor undertakes to construct a particular facility at the request of the employer, or to perform other construction work, and the employer undertakes to build 2. The construction contract shall be for the construction or reconstruction of the prepast. The rules on contract are set out in annex II to the present report. In the cases provided for in the contract, the contractor shall assume responsibility for the major maintenance of the buildings and structures, unless otherwise provided for in the contract. 3. In cases where the construction contract provides for work to be performed in order to be satisfactory, the facility must be capable of being operated after its acceptance by the contracting authority within the time period specified in the contract. The rules of paragraph 2 of the present chapter on the rights of the employer under the contract of accommodation shall apply accordingly to such a contract.
