Article 1361: The right of prior use of an invention, a useful model or an industrial model

1. A person who, prior to the date of the priority of the invention, a useful model or industrial model (arts. 1381 and 1382) used in good faith in the territory of the Russian Federation created independently of the vehicle An identical decision or decision that differs from the invention only by equivalent elements (art. 1358, para. 3), or has made the necessary preparations for it, retains the right to continue 2. The right of prior use may only be transferred to another person together with other persons. The Committee recommends that the State party take all appropriate measures to ensure that the State party’s compliance with the provisions of the Convention is not compromised by the fact that the State party’s failure to comply with its obligations under the Covenant is not incompatible with the Covenant.
