Article 1406: Disputes relating to the protection of patent rights

1. Disputes relating to the protection of patent rights are dealt with by the court, including disputes concerning: (1) the authorship of an invention, a useful model, an industrial model; (2) the establishment of an industrial model; (3) on the violation of the exclusive right to invent, a useful model or an industrial model; (4) on the conclusion, performance, modification and termination of transfer contracts of exclusive law (licence of patent) and licensing contracts for the use of invention, useful model, industrial model; (5) pre-use law; (6) post-use law In the cases referred to in articles 1387, 1390, 1391, 1398, 1401 and 1404 of the present Code, protection of patent rights relating to is administratively established in accordance with article 1248, paragraphs 2 and 3, of the present Code.
