Article 1434: Priority for a selection achievement

1. The priority of a selection achievement shall be set at the date of entry into the federal executive branch, on the basis of the selective achievements of the patent application. 2. If on the same day, Two or more patent applications for the same breeding achievement are submitted to the federal executive branch on the basis of selection achievements; priority is given to earlier ones. If it is determined by an expert examination that the applications have the same date of dispatch, the patent may be granted on the basis of an application with an earlier registration number assigned to the federal authority. 3. If the application for a patent has been submitted to the federal org, it shall be subject to the approval of the executive branch on the basis of a selection achievement, provided that the agreement between the applicants does not provide otherwise. Prior to the applicant ' s application in a foreign State with which the Russian Federation had concluded a contract on the protection of the secluded dosages, the Government of the Russian Federation had concluded an application for the protection of the secluded dosages. The applicant enjoys the priority of the first application within twelve months of the date of its submission. The applicant must specify the date of priority of the first application. within six months of the date of the application to the federal executive branch, the applicant must submit a selection progress report within six months of the date of receipt of the application. A copy of the first application, certified by the competent authority of the foreign State concerned, and its translation into Russian. The documentation and the material required for the test shall be completed within three years of the date of the first application.
