Article 1541: Relationship between the right to commercial designation and the rights to the trade name and mark

1. The exclusive right to a commercial designation, including the trade name of the owner or certain elements thereof, arises and operates independently of the exclusive right to a trade name. 2. The trade name or elements of this name may be used by the right holder in his or her trade mark. In the trademark, it is protected irrespective of the security of the trademark.
