Article 78. Exemption from criminal liability in connection with the expiration of the statute of limitations

1. A person shall be exempt from criminal liability if the following periods have expired from the date of the commission of the offence: (a) two years after the commission of a minor offence; (b) six years after the commission of the offence 2. The statute of limitations shall be calculated from the date on which the offence was committed. If a person commits a new offence, the statute of limitations for each crime shall be calculated independently. The penalty shall be suspended if the perpetrator of the offence avoids the investigation or trial or the payment of the judicial fine imposed under article 76.2 of the present Code. 4. The statute of limitations shall be renewed from the moment the person is detained or brought to trial. 4. Question of the application of the statute of limitations to a person who has committed an offence punishable by death If the court does not find it possible to exonerate the person in question from criminal liability in connection with the expiry of the statute of limitations, the death penalty and the death penalty shall be decided by the court. 5. Persons who have committed offences under articles 205,205.1, 205.3, 205.4, 205.5, paragraphs 3 and 4 of article 206, part 4 of article 211 shall not be liable to life imprisonment. articles 281 to 281.3.353, 356.357, 358.361 of the present Code, as well as offences connected with the conduct of terrorist activities under articles 277,278,279 and 360.
