Article 114: Establishment of a unitary enterprise and its statutory fund

1. A unitary enterprise shall be established on behalf of a public legal entity (art. 125) by a decision of the authorized public authority or local self-government. The statutory fund of a unitary enterprise is defined by the law on State and municipal unitary enterprises. 3. The procedure for the establishment of the statutory fund of a unitary enterprise is established. 4. If, at the end of the fiscal year, the value of the net assets of the unitary enterprise is less than the amount of the statutory fund, If the value of net assets becomes less than the amount determined by law, the toilet shall be required to reduce the statutory fund in accordance with the established procedure. 5. In the event of a decision to reduce the statutory fund, the unitary enterprise is required to notify its creditor in writing. The creditor of a unitary enterprise is entitled to claim termination or early performance of the obligation to which the business is owed and damages.
