Article 1146: Succession by right of submission

1. The share of the heir, by law, who died before the opening of the inheritance or at the same time as the heir (art. 1114, para. 2) shall pass by the right of submission to his or her respective descendants in the event of failure to do so. 2 of article 1142, paragraph 2 of article 1143 and paragraph 2 of article 1144 of the present Code, and divided equally between the two. 2 Do not inherit by right the progeny of the heir by law, deprived of the right to be represented by the heir 3. Do not inherit the right to represent the descendant of the heir who died before the opening of the heir or at the same time as the heir (art. 1, para. 2) 114) and who would not be entitled to inherit under article 1117, paragraph 1, of the present Code.
