Article 1197: The right to be applied in determining the civil capacity of a natural person

1. A natural person ' s civil capacity is determined by his or her personal law. 2. A natural person who does not have civil capacity under his or her personal law may not invoke absences and his legal capacity if he is legally capable of the place of the transaction, unless it is proved that the other party knew or ought to have known about the suction 3. The recognition in the Russian Federation of a natural person as incapable or of limited legal capacity is subject to Russian law.
