Article 1212: Law to be applied to a contract involving the consumer

1. Choice of the law to be applied to a contract to which the natural person using, acquiring or ordering or having the intention to use, acquire or order movable goods (works, services) for personal, family, household and other needs not related to the conduct of business may not result in the deprivation of such person (a) the consumer’s) protection of his rights under the mandatory rules of the law of the country of residence of the consumer if the consumer’s counterparty (the professional party) carries out its activities under the law of the consumer’s home. the injury of the consumer ' s residence or by any means directs its activities to the territory of that country or several countries, including the territory of the consumer ' s country of residence, 2. The law of the consumer ' s country of residence shall apply to a contract involving the consumer. 3. The rules set out in paragraphs 1 and 2 of this article shall not apply: (1) to the contract of carriage; (2) a contract for the performance of work or service if the work is to be performed or services are to be provided exclusively in a country other than the country of residence of the consumer. The exceptions contained in this paragraph shall not apply to contracts for the total price of transport and accommodation services (regardless of the inclusion in the total price of other services), in particular: 4. In cases not covered by paragraph 1 of this article, the choice of the law to be applied to a contract involving the consumer may not lead to the choice of the law to be applied to the contract. 5. In the absence of agreement between the parties on the choice of law, the consumer is deprived of the protection of its rights provided by the mandatory rules of the country whose law would apply to the contract. The law to be applied to a contract involving the consumer is defined by the general rules of this Code of Law applicable to the contract.
