Article 147: Responsibility for the validity of rights certified by documentary securities

1. The person who has handed over the documentable security is liable for the invalidity of rights certified by the security unless otherwise established by law. 2. The holder of the security document who detects it under the law shall be liable for the performance of the obligation under it, subject to the relevant reservation and in other cases established by law. A fraud or forgery is entitled to claim from the grantor the performance of the security obligations and damages.
