Article 255. Treatment of shares in common property
The participant ' s creditor of equity or joint property, if the owner of the other property is in short supply, is entitled to claim the debtor ' s share of the common property for application to the debtor ' s property. If in such cases it is not possible to allocate a share in kind or the other participants in the equity or joint ownership object to it, the creditor is entitled to claim the sale by the debtor of the joint property. In the event of refusal by the other participants, the share of the remaining participants in the common property, at a price commensurate with the market value of the share, will be applied to the proceeds of the sale for repayment of the debt. The creditor is entitled to claim from the court the recovery of the debtor ' s share of the common property right by selling the share from a public tender.
