Article 333. Reduction of penalties

1. If the penalty to be paid is clearly disproportionate to the consequences of the breach of the obligation, the court is entitled to reduce the penalty. 2. Reduction of the liability specified by the contract to be paid by the person carrying out the business an activity is permitted in exceptional cases if it is proved that the recovery of damages in the amount provided for in the contract may result in an undue benefit to the creditor. The rule of this article does not affect the right of the debtor to reduce its liability under articles 404 of this Code and the right of the creditor to damages in cases 394 of the present Code.
