Article 334.1: Basis for the creation of bail

1. A bond between a pledgeor and a pledge holder arises on the basis of a contract; in cases established by law, a bond arises on the basis of the circumstances specified in the law (a lien on the basis of the contract). 2. The rules of this Code on bail under a contract shall apply accordingly to a pledge arising under the law, unless otherwise provided by law. 3. In accordance with the law, the pledgeor and the pledge holder are entitled to conclude an agreement governing their relationship; the rules of this Codexao shall apply to such agreement in the form of a pledge contract.
