Article 405. Debtor ' s time limit

1. The debtor who is in default shall be liable to the creditor for the loss caused by the delay and for the consequences of the accidental failure to perform during the delay. 2. The debtor ' s delay has lost interest in the creditor, it may refuse to accept performance and claim damages. 3. The debtor is not considered to be in arrears until the obligation has been met. It may be enforced by reason of the creditor ' s delay.
