Article 460 Obligation of the seller to deliver goods free of the rights of third parties

1. The seller is under an obligation to deliver the goods to the buyer free of any third-party rights, unless the buyer has agreed to accept the goods subject to third-party rights. Under this obligation, the buyer is entitled to claim a reduction in the price of the goods or avoidance of the contract of sale unless it is proved that the buyer knew or ought to have known of the rights of third parties. 2. The rules provided for in paragraph 1 of this article shall apply accordingly when the goods were claimed by third parties to the buyer at the time they were handed over. These claims were subsequently declared to be lawful in accordance with the established procedure.
