Article 826. Monetary claim subject to assignment

1. The subject matter of an assignment under a factoring contract may be a monetary claim or a monetary claim: (1) an existing obligation, including an obligation arising from a contract concluded (a) In respect of which payment is due or not due (existing claim); (2) in respect of an obligation that will arise in the future, including from a contract to be concluded in the future (future t) 2. The monetary claim shall be transferred to the financial agent (factor) at the time of the conclusion of the factoring contract, unless otherwise established by such contract. 3. If the contract of factoring is concluded earlier than the time of the contract, if the contract does not provide that the future claim shall pass at a later date. There is no need for further processing of the transfer of the monetary claim to the financial agent (factor).
