Article 860.12: Public deposit account operations performed by the bank
1. In a public deposit account, the holder of the account may, on the basis of the order(s), transfer or issue the deposit funds to the beneficiary and return them. Other transactions in the public deposit account and crediting of the account (Article 850) are not permitted unless otherwise provided. 2. The holder of the public deposit account shall be liable to the beneficiary and the depositor for performing such account transactions in violation of the deposit rules established by law. 3. The bank shall not be liable to the beneficiary and the depositor for the conduct of transactions in the public deposit account on the basis of the order(s) of the holder of the account with the violation established The deposit rules of the law, unless the bank has failed to comply with the statutory obligation to control the use of money in the account.
