Article 1437. Expertification of a selection achievement to be new

1. Any interested person may, within six months from the date of publication of the application for a patent, submit to the federal executive authority the progress made by the applicants in the selection process. The Federal Executive Authority for Selective Achievements notifies the Federal Government of the application for an evaluation of the declared selection achievement. The applicant shall have the right to submit to the federal executive authority, within three months of receiving the notification, a statement of the merits of the application. 2. According to the available material, the federal executive body shall, on the basis of the progress achieved in the selection process, take a decision and inform the person concerned thereof. The lecture achievement does not meet the criterion of innovation, and a decision is taken not to grant a patent for a breeding achievement.
