Article 49: Legal capacity of a legal person

1. A legal person may have civil rights corresponding to the purposes of the activities provided for in its constituent instrument (art. 52) and be bound by those activities. Ommerical organizations, with the exception of unitary enterprises and other types of organizations provided for by law, may have civil rights and bear the civil obligations necessary for the exercise of their duties. In cases provided for by law, a legal person may only engage in certain activities on the basis of special authorization. 2. A legal person may be restricted in rights. 3. The legal capacity of a legal person arises from the moment of entry into the e-mail. The State register of legal persons shall cease to exist at the time of the entry into the said register of information on its termination.
