Article 364. The grantor ' s right to object to a creditor ' s claim

1. The sponsor shall have the right to raise objections against the creditor ' s claim which the debtor could have raised, unless otherwise provided by the contract of sponsorship. 2. The sponsor is entitled not to discharge his obligation while the creditor is able to obtain the satisfaction of its claim. 3. In the event of the debtor ' s death, the guarantor of this obligation may not invoke the limited liability of the heirs of the debtor ' s estate. 4. A sponsor who has acquired the rights of a fellow holder or rights under other security of the underlying obligation is not entitled to exercise them to the detriment of the creditor, including: is not entitled to satisfy its claim against the debtor from the value of the encumbered property until the creditor ' s claims under the underlying obligation have been fully satisfied. It is not permitted to raise objections that the debtor might raise; otherwise, the agreement is null and void.
