Article 452. Procedure for modification and avoidance

1. An agreement to modify or avoid a contract shall take the same form as a contract, unless otherwise required by law, other legal acts, contract or custom. or the avoidance of a contract may be declared by a party to the court only after receipt of the refusal of the other party to propose to modify or terminate the contract or the failure to respond within the time period specified in paragraph (a) above. or by law or by contract or, in its absence, within 30 days.
