Article 1209: The law to be applied to the form of a transaction

1. The form of the transaction is subject to the law of the country to be applied to the transaction itself; however, the transaction cannot be declared invalid by reason of non-compliance with the form if the requirements of the law of art are met. A transaction performed abroad, at least one of whose parties is a person whose personal law is Russian law, cannot be deemed to be unfavourable. The rules provided for in the first paragraph apply also to the form of trust. The law of the country of residence of the consumer shall apply to the form of the contract with the participation of the consumer of his or her choice, as specified in article 1212, paragraph 1, of the present Code. The wounds of the place where a legal person is established contain special requirements as to the form of the contract for the establishment of a legal person or of the transaction relating to the exercise of the rights of a participant in the legal person, 3. The form of the transaction in respect of immovable property is subject to the law of the country where the property is located and the form of the transaction in respect of immovable property is subject to the law of the country where the property is located.
