Article 1219: Right to apply to obligations arising out of injury

1. The law of the country in which the act or other circumstance giving rise to the claim for damages is applicable to obligations arising as a result of the injury. If, as a result of such an act or other circumstance, the injury occurred in another country, the law of that country may be applied if the harmer anticipated or should have foreseen the attack 2. If the parties to the obligation arising from the injury have residence or principal place of activity in the same country, the law shall apply If the parties to the obligation have residence or main place of activity in different countries but are nationals or legal persons of the same country, apply 3. If it appears from the totality of the circumstances of the case that the obligation arising out of the injury is closely related to the contract between the victim and the causer of the injury 4. The rules of this article shall apply to the obligation in question. If there is no agreement between the parties on the right to be applied to the obligation arising out of the injury (art. 1223.1).
