Article 1101.Award and amount of compensation for moral injury

1. Compensation for moral damage shall be in monetary form. 2. The amount of compensation for moral injury shall be determined by the court according to the nature of the physical and moral injury suffered by the victim. In determining the amount of compensation for harm, the requirements of reasonableness and crucifix must be taken into account. The nature of the physical and moral suffering is assessed by the court in the light of the actual circumstances in which the moral injury occurred and the individual characteristics of the victim.
