Article 860.10: Closure of the escrow account

1. Unless otherwise provided in the escroo contract, the closure of the eskrou account shall be effected by the bank upon expiry of the term of validity or termination on other grounds of the eskrou contract. 2. Unless otherwise provided in the agreement between the depositor and the beneficiary, upon termination of the account, the escro balance shall not apply to the escru account. The funds shall be transferred or given to the depositor or, if there are reasons for transferring the funds to the beneficiary, shall be transferred or given to the beneficiary.
