Article 365: Rights of the guarantor who has fulfilled the obligation

1. The rights of the creditor under this obligation and the rights of the creditor as collateral shall be transferred to the guarantor of the obligation to the extent that the guarantor has satisfied the three-way obligation. The sponsor is also entitled to claim interest from the debtor on the amount paid to the creditor and other damages incurred in connection with the debtor ' s liability. 3. The creditor is required to hand over to the guarantor documents certifying the debtor ' s claim and to transfer the rights securing the claim. The provisions of the article in question apply, unless otherwise provided by law, other legal acts or the bondor ' s contract with the debtor, and do not derive from the relationship between them.
