Article 881. Guarantee of payment

1. Payment of a cheque may be guaranteed in whole or in part by avalanche; the guarantee of payment of a cheque (aval) may be given by any person except the payer. On the face of the cheque or on an additional sheet, by the inscription «calculate for the aval» and by whom and by whom it is given. If it is not indicated who it is given for, the aval is considered to have been given for the cupboard. is signed by the Avalist indicating the place of his residence and the date of the inscription, and if the Avalist is a legal person, the place of his or her residence and the date of his or her inscription. 3. As he for whom he has given the Avalanche, even if the obligation which he has guaranteed is null and void on any ground, otherwise, his obligation is only to his Lord. 4. The payee who paid the cheque acquires the rights arising from the cheque against the person for whom he gave the guarantee and against those who owe it to the latter.
