Article 171. Inviolability of a transaction made by a national deemed to be incompetent

1. Nothing is a transaction made by a citizen who has been found to be incompetent because of a mental disorder; each of the parties to such a transaction is obliged to return to the other whatever is received in kind and in the event of non-compliance. The possibility of returning what is received in kind is to recover its value; the party in a position to do so is also obliged to compensate the other party for the real damage it has suffered if the party in power knew 2. In the interest of a citizen who is found to be incompetent as a result of a mental disorder, the transaction he has made may be made at the request of eg. the guardian is deemed valid by the court if it is committed to the benefit of the citizen.
