Article 749: Participation of an engineer (engineering organization) in the exercise of rights and performance of the duties of the employer

In order to control and supervise the construction and make decisions on its behalf with the contractor, the employer may enter into a contract on its own without the contractor ' s consent. In this case, the construction contract specifies the functions of the engineer(s) related to the impact of its actions on the contractor.
